  • Embrione: qualcosa o qualcuno? La Corte Costituzionale di fronte alla logica stringente della fecondazione in vitro

    di Giacomo Rocchi

    Abstract

Embryos production through in vitro fertilisation techniques generates the opinion that they’re items and may be manipulated for scientific research when not successfully employed to cause a pregnancy. The Constitutional Court, in judging the legality of the ban, should reaffirm the embryos right to life. Internationally some opposing rulings have been observed including one issued by the Inter-American Court of Human Rights against Costa Rica. Conflicts are also possible between the European Court of Human Rights and the Italian Constitutional Court. The decision could impact jurisprudence orientation on other issues, such as euthanasia.
