This paper studies the effectiveness of the introduction of leniency programs in European and Italian antitrust law, trying to explain the reason underlying the two different effects. We start by analyzing the introduction of the program, showing the ratio that led to introduce it in US first, eventually becoming a worldwide tool for cartel fighting.
The paper takes into account European and Italian cartel data available from 1996 to June 2018, obtaining a comparison between leniency applications results. Finally, we provide a Bayesian model capturing cartel member’s decision situation, showing programs defects and improvement possibilities.
