SPILLOVER EFFECTS OF THE IMPLEMENTATION OF EU LAW – A THREAT TO THE COHERENCE OF NATIONAL PRIVATE LAW?

The conference is intended as a kick-off for a series of events and research projects exploring the impact of EU
law on the coherence of national private law. It deals with a phenomenon that Angus Johnston has described
as ‘spillover effects’: the implementation of EU legislation that reaches beyond its originally intended field of
application, thereby creating a larger impact on the coherence of national law. This impact is discussed with
regard to various examples in which it seems to become especially relevant, each from an Italian and a German
perspective, representing different national civil law frameworks and approaches to the implementation of EU
legislation in general.
